Laws incorporated in this privacy policy<\/strong><\/p>\n

This privacy policy is adapted to current Spanish and European regulations regarding the protection of personal data on the internet. Specifically, it respects the following rules:<\/p>\n

    Registration of Personal Data<\/strong><\/p>\n

    In compliance with the provisions of the GDPR and the LOPD-GDD, we inform you that the personal data collected by Tubosdebaja, through the forms provided on its pages, will be incorporated and processed in our Register of Processing Activities in order to facilitate, streamline and fulfil the commitments established between Tubosdebaja and the User, or the maintenance of the relationship established in the forms filled out by the latter, or to respond to a request or enquiry. Likewise, in accordance with the provisions of the GDPR and the LOPD-GDD, unless the exception provided for in Article 30.5 of the GDPR applies, a record of processing activities is maintained which specifies, according to its purposes, the processing activities carried out and the other circumstances established in the GDPR.<\/p>\n

    Principles applicable to the processing of personal data<\/strong><\/p>\n

    The processing of the User's personal data shall be subject to the following principles set out in Article 5 of the GDPR and in Article 4 et seq. of Organic Law 3\/2018, of 5 December, on the Protection of Personal Data and guarantee of digital rights:<\/p>\n

    • Principle of storage period limitation: personal data shall only be kept in a form which permits identification of the User for no longer than is necessary for the purposes of its processing.<\/li>\n
    • Principle of integrity and confidentiality: personal data shall be processed in a manner that ensures its security and confidentiality.<\/li>\n
    • Principle of proactive accountability: the Data Controller shall be responsible for ensuring that the above principles are met.<\/li>\n<\/ul>\n

      Categories of personal data<\/strong><\/p>\n

      For the correct development of its commercial activity and the provision of the requested services, VILATRENZ 2000 S.L. processes the following categories of personal data:<\/p>\n

      • Commercial transaction data: Information regarding the products purchased (hoses, tubes, accessories), order history, quantities, amounts and purchase details. This data includes the commercial segmentation of the User for the application of rates and discounts based on purchase volume.<\/li>\n
      • Economic and financial data: Data necessary for issuing invoices (NIF\/CIF) and information for managing payments through secure payment gateways.<\/li>\n
      • Browsing data: IP address, device identifiers, browser type and behaviour data on the Website for security purposes and experience improvement.<\/li>\n<\/ul>\n

        Under no circumstances are special categories of personal data processed within the meaning of Article 9 of the GDPR (such as data revealing ethnic origin, political opinions, religious beliefs, health data or sexual orientation).<\/p>\n

        Legal basis for the processing of personal data<\/strong><\/p>\n

        The legal basis for the processing of personal data by VILATRENZ 2000 S.L. is based on the following grounds:<\/p>\n

        • Performance of a contract:<\/strong> The processing is strictly necessary for administrative management, collection, delivery of technical products (hoses, tubes and accessories) and the provision of the services requested by the User through the Website.<\/li>\n
        • Compliance with legal obligations:<\/strong> The processing is necessary to comply with tax (VAT), commercial and accounting regulations in force in Spain and the European Union, including the issuance of invoices and the maintenance of records according to the Verifactu system.<\/li>\n
        • Consent of the data subject:<\/strong> For purposes that are not necessary for the purchase (such as sending newsletters, responding to contact forms or the use of analytical cookies), VILATRENZ 2000 S.L. undertakes to obtain the express, free and unequivocal consent of the User. The User shall have the right to withdraw their consent at any time.<\/li>\n
        • Legitimate interest:<\/strong> We may process data to ensure the security of the Website and prevent fraud or misuse of the platform.<\/li>\n<\/ul>\n

          Purposes of the processing for which the personal data are intended<\/strong><\/p>\n

          Personal data are collected and managed by Tubosdebaja for the purpose of facilitating, streamlining and fulfilling the commitments established between the Website and the User, or maintaining the relationship established in the forms filled out by the latter, or to attend to a request or enquiry.<\/p>\n

          Likewise, the data may be used for a commercial purpose of personalisation \u2014including segmentation for the application of price scales according to purchase volume\u2014, operational and statistical purposes, and activities specific to the corporate object of VILATRENZ 2000, S.L.<\/p>\n

          Retention periods of personal data<\/strong><\/p>\n

          Personal data will only be kept for the minimum time necessary for the purposes of its processing. In compliance with current regulations, the following conservation criteria will be applied:<\/p>\n

          • Customer and contract performance data:<\/strong> They will be maintained for the duration of the commercial relationship and, once ended, during the limitation periods of the legal actions that could derive from it (generally between 3 and 5 years depending on the nature of the claim).<\/li>\n
          • Data for marketing purposes and enquiries:<\/strong> They will be kept until the User requests their deletion or withdraws their consent, provided that there is no legal obligation to the contrary.<\/li>\n
          • Browsing data and cookies:<\/strong> They will be kept according to the periods specified in our Cookies Policy, for a maximum of 12 months.<\/li>\n<\/ul>\n

            At the end of the indicated periods, or when the data are no longer necessary for the purpose that motivated their collection, they will be duly blocked, deleted or anonymised to prevent further processing, except for making them available to public administrations, judges and courts.<\/p>\n

            Recipients of personal data<\/strong><\/p>\n

            To fulfil the purposes described above, the User's personal data may be communicated to the following recipients:<\/p>\n

            • Transport and logistics service providers:<\/strong> In order to manage the shipment and physical delivery of the technical products purchased by the User through the Website.<\/li>\n
            • Financial entities and payment platforms:<\/strong> For the secure processing of collections and payments derived from commercial transactions.<\/li>\n
            • Tax and accounting advisors:<\/strong> To comply with the legal obligations of VILATRENZ 2000 S.L. regarding invoicing and commercial accounting.<\/li>\n
            • Authorities and Public Bodies:<\/strong> In those cases where there is a legal obligation to provide said data, especially to the Tax Agency and judicial bodies.<\/li>\n<\/ul>\n

              VILATRENZ 2000 S.L. guarantees that, outside of these cases necessary for the execution of the contract or compliance with the law, personal data will not be transferred, sold or shared with third parties without the prior consent of the User.<\/p>\n

              Personal data of minors<\/strong><\/p>\n

              Respecting the provisions of Articles 8 of the GDPR and 7 of Organic Law 3\/2018, of 5 December, on the Protection of Personal Data and guarantee of digital rights, only those over 14 years of age may give their consent for the lawful processing of their personal data by Tubosdebaja. In the case of a minor under 14 years of age, the consent of parents or guardians will be necessary for the processing, and this will only be considered lawful to the extent that they have authorised it.<\/p>\n

              Secrecy and security of personal data<\/strong><\/p>\n

              VILATRENZ 2000, S.L. undertakes to adopt the necessary technical and organisational measures, according to the level of security appropriate to the risk of the data collected, in such a way as to guarantee the security of personal data and avoid the accidental or unlawful destruction, loss or alteration of personal data transmitted, stored or otherwise processed, or unauthorised communication or access to said data.<\/p>\n

              The Website has an SSL (Secure Socket Layer) certificate, which ensures that personal data is transmitted securely and confidentially, as the transmission of data between the server and the User, and in feedback, is fully encrypted or encoded.<\/p>\n

              However, because the invulnerability of the internet cannot be guaranteed, nor the total absence of hackers or others who fraudulently access personal data, the Data Controller undertakes to notify the User without undue delay when a breach of personal data security occurs that is likely to entail a high risk to the rights and freedoms of natural persons. Following the provisions of Article 4 of the GDPR, a breach of personal data security is understood as any security breach that causes the accidental or unlawful destruction, loss or alteration of personal data transmitted, stored or otherwise processed, or unauthorised communication or access to said data.<\/p>\n

              VILATRENZ 2000 S.L. guarantees that the User's personal data will be treated with the utmost reserve and confidentiality. The Data Controller undertakes to ensure that all its employees, collaborators and any third party who has access to the information by reason of the provision of the service, are subject to an obligation of professional secrecy, either through contractual clauses or by legal imperative. This obligation shall be maintained even after the end of the relationship with the User or with the personnel in charge of the processing.<\/p>\n

              Rights derived from the processing of personal data<\/strong><\/p>\n

              The User has over and may, therefore, exercise against the Data Controller the following rights recognised in the GDPR and Organic Law 3\/2018, of 5 December, on the Protection of Personal Data and guarantee of digital rights:<\/p>\n

              • Right of access: <\/strong>This is the User's right to obtain confirmation as to whether or not their personal data is being processed and, if so, to obtain information about their specific personal data and the processing carried out or being carried out, as well as, among other things, the information available on the origin of said data and the recipients of communications made or planned for them.<\/li>\n
              • Right to rectification:<\/strong> This is the User's right to have their personal data modified if it proves to be inaccurate or, taking into account the purposes of the processing, incomplete.<\/li>\n
              • Right to erasure (\"the right to be forgotten\"):<\/strong> This is the User's right, provided that current legislation does not establish otherwise, to obtain the erasure of their personal data when these are no longer necessary for the purposes for which they were collected or processed; the User has withdrawn their consent to the processing and this has no other legal basis; the User objects to the processing and there is no other legitimate reason to continue with it; the personal data have been processed unlawfully; the personal data must be erased in compliance with a legal obligation; or the personal data have been obtained as a result of a direct offer of information society services to a child under 14 years of age. In addition to erasing the data, the Data Controller, taking into account the available technology and the cost of its application, must take reasonable measures to inform the controllers who are processing the personal data of the data subject's request to erase any link to those personal data.<\/li>\n
              • Right to restriction of processing:<\/strong> This is the User's right to restrict the processing of their personal data. The User has the right to obtain the restriction of processing when they contest the accuracy of their personal data; the processing is unlawful; the Data Controller no longer needs the personal data, but the User needs it to make claims; and when the User has objected to the processing.<\/li>\n
              • Right to data portability:<\/strong> In the event that the processing is carried out by automated means, the User shall have the right to receive their personal data from the Data Controller in a structured, commonly used and machine-readable format, and to transmit them to another data controller. Whenever technically possible, the Data Controller will transmit the data directly to that other controller.<\/li>\n
              • Right to object: <\/strong>This is the User's right not to have the processing of their personal data carried out or to cease the processing thereof by Tubosdebaja.<\/li>\n
              • Right not to be subject to a decision based solely on automated processing, including profiling:<\/strong> This is the User's right not to be subject to an individualised decision based solely on the automated processing of their personal data, including profiling, unless current legislation establishes otherwise.<\/li>\n<\/ul>\n
